Welcome to Evolve Poke Center (the "Evolve Poke Center"), an online retailer specializing in Pokémon Trading Card Game (TCG) products, including sealed packs, booster boxes, singles, accessories, and related collectibles. These Terms of Service, govern your access to and use of our website and services. By accessing or using the Services, placing an order, or making a purchase, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

1. Products and Orders

  • All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.
  • Product images, descriptions, and prices are for illustrative purposes and may vary. We strive for accuracy but are not responsible for minor discrepancies.
  • All Pokémon TCG products sold are guaranteed to be 100% authentic and sourced from legitimate distributors. We do not sell counterfeit or altered items.
  • By placing an order, you confirm acceptance of the product condition (e.g., new/sealed for packs, graded or near-mint as described for singles).

2. Pricing and Payment

  • Prices are listed in USD and exclude shipping, taxes, and any applicable fees, which will be calculated at checkout.
  • We accept payments via Shopify's secure payment processors. You authorize us to charge your selected payment method.
  • All sales are final upon completion of payment.

3. Shipping and Delivery

  • Shipping details, rates, and estimated delivery times are provided at checkout.
  • Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays, lost packages, or damage caused by carriers.
  • International orders may incur customs duties, which are your responsibility.

4. All Sales Final – No Returns, Refunds, or Exchanges

Due to the collectible and sensitive nature of Pokémon TCG products (including risks of tampering, resealing, or fraud), all sales are final. We do not accept returns, exchanges, or issue refunds for change of mind, buyer's remorse, or any non-defective reasons.

Exceptions may be made solely at our discretion for:

  • Damaged, defective, or incorrect items received.
  • You must contact us at info@Evolvepokecenter.com within 7 days of delivery with photos and order details.
  • If approved, we may offer a replacement (if available), partial/full refund, or store credit.

5. Intellectual Property

All content on the Services, including product images (except official Pokémon artwork), text, and logos, is owned by us or our licensors. Pokémon trademarks, characters, and artwork are owned by The Pokémon Company International, Nintendo, Creatures Inc., and GAME FREAK Inc. We are not affiliated with, endorsed by, or sponsored by these entities.

You may not reproduce, distribute, or use any content without our prior written permission.

6. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful purposes.
  • Attempt to tamper with, resell counterfeit items, or engage in fraudulent activity (e.g., chargebacks for non-defective items).
  • Interfere with the Services or overburden our systems.

We reserve the right to refuse service, cancel orders, or terminate access for violations.

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Services or products. Our total liability shall not exceed the amount paid by you for the product in question.

Products are sold "as is" with no warranties beyond those explicitly stated.

These Terms are governed by the laws of United States and New York, without regard to conflict of laws principles.
